Firstly – we are delighted to be working with you. For clarity, our terms and conditions are set out below. This document should be viewed as binding, and sets out the contract terms applicable to all products and services provided by Tynan D'Arcy.
All work is undertaken by Tynan D'Arcy on the understanding that once the client accepts and places an order with Tynan D’Arcy, the client is in accord with our terms and conditions as laid out.
On recipt of a brief, Tynan D'Arcy will supply a written proposal and quote. On acceptance of the quote via telephone or email, Tynan D'Arcy will commence work. Our terms and conditions overule any conditions set out on the clients purchase order.
If the brief changes in any way – Tynan D’Arcy reserve the right to amend the quote to reflect this.
Tynan D'Arcy will list all charges in the quote. If the job develops and costs are amended, the most recent quote will superceed the previous quote and the contract between agency and client is deemed accepted on the most recent quote.
Our terms of payment are 30 days unless agreed otherwise. If payment is delayed to the agreed payment terms, Tynan D'Arcy reserve the right to apply late payment charges.
Any invoice query must be submitted by email within 14 days of the invoice date.
Where progression of a project is dependent on the client supplying assets to Tynan D'Arcy – if a delay occurs in supply, then we accept no responsibility if deadlines are then pushed back to reflect this.
Copyright remains owned by Tynan D'Arcy on all design work to include visuals, illustrations, words and pictures until agreed in writing or costs have been settled.
All design work should be registered by the client with the appropriate authorities prior to publishing, and legal advice sought to its use. Tynan D'Arcy will not be held responsible for any damages resulting from any claims.
Any claim against Tynan D'Arcy shall be limited to the relevant fees paid by the customer.
Once a template is approved, coding will begin. Any changes thereafter for navigation, structure or content may be subject to an additional charge.
Tynan D'Arcy are not responsible for the security of the client website unless specifically requested by the client. We offer creative services in the design, structure, formatting of the website, and provide hosting services through an out-sourced managed hosting service.
Tynan D'Arcy does not guarantee continuous service and will accept no liability for loss of service, whatever the cause.
Search Engine/Optimisation – due to the constant updating and refining of search engines, Tynan D'Arcy recommend a thorough security and SEO audit regularly. It is the clients responsibility to ensure that the site and content is secure.
Following a quote approval, if the order is then cancelled, the client will be invoiced for any work completed, and will honour any contracts that Tynan D'Arcy has undertaken on the clients behalf such as flights, hotels, images, freelancers etc.
Tynan D'Arcy makes no warranties of any kind, express or implied, for any and all products and /or services that it supplies. We take steps to investigate any materials, construction or service, however, we accept no responsibility for any loss arising from their failure.
